1. Introduction and Acceptance

Welcome to Selfie Anywhere (“Service,” “App,” “we,” “us,” or “our”). By accessing or using our Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use our Service.

Selfie Anywhere is an AI-powered creative tool that generates fictional travel imagery. All images created by this Service are AI-generated and do not represent real photographs.

By clicking “Accept,” installing, or using the App, you confirm you have the authority to enter these Terms (including on behalf of a company or entity, if applicable).

You represent and warrant that you are at least 16 years old. If you are 16 or 17, you affirm you have parental or legal guardian consent to use the Service. Where the applicable minimum age in your jurisdiction is higher, you may only use the Service if you meet that higher age threshold. The Service is not available where use would violate local age or eligibility rules.

2. Description of Service

Selfie Anywhere uses artificial intelligence to create synthetic images that combine:

• A user-provided photograph (your “Base Image”)
• Location imagery and data from third-party services
• AI image generation technology

Important: The resulting images are entirely synthetic and AI-generated. They do not represent actual events, locations visited, or real photographs.

The Service may include updates, supplements, and internet-based services. Unless separate terms accompany an update, this EULA applies to all of them.

3. Acceptable Use Policy

3.1 Permitted Uses

You MAY use Selfie Anywhere for:

• Personal entertainment and creative expression
• Creating clearly fictional or artistic content
• Social media posts that are clearly labeled as AI-generated
• Non-commercial creative projects
• Educational purposes

3.2 Prohibited Uses

You MUST NOT use Selfie Anywhere to:

Fraud and Deception

• Create images intended to deceive others about your actual location or activities
• Produce fake evidence or alibis
• Mislead others about real-world events or circumstances
• Commit insurance fraud, legal fraud, or any other fraudulent activity
• Create fake travel documentation or proof of travel

Impersonation and Identity

• Generate images using another person’s likeness without their explicit consent
• Create images of minors (anyone under 18 years of age)
• Impersonate public figures, celebrities, or any other individuals
• Create deepfakes or non-consensual intimate imagery
• Violate any person’s right to privacy or publicity

Harmful Content

• Generate content that is defamatory, libelous, or harassing
• Create content that promotes violence, hatred, or discrimination
• Produce sexually explicit or pornographic content
• Generate content that exploits or endangers minors
• Create content related to terrorism or illegal activities

Platform Violations

• Violate the terms of service of any social media platform
• Circumvent AI-detection systems or content moderation tools
• Remove, obscure, or alter AI-generated watermarks or metadata
• Misrepresent AI-generated images as real photographs

Unauthorized Use and Delegation

• Allow third parties to use the Service on your behalf or share access credentials
• Use the Service in violation of applicable local, national, or international laws

Commercial Misuse

• Use generated images for commercial purposes without a commercial license
• Sell or distribute generated images as stock photography
• Use images in advertising without proper disclosure
• Claim copyright ownership over AI-generated content

3.3 Consequences of Violation

Violations of this Acceptable Use Policy may result in:

• Immediate termination of your account without refund
• Removal of content or generated images without prior notice
• Permanent ban from the Service
• Reporting to relevant authorities for illegal activities
• Legal action to recover damages
• You may appeal enforcement actions by emailing support@selfie-anywhere.app with context; we may refuse or limit appeals for repeated or severe violations

4. AI-Generated Content Disclosure

4.1 Disclosure Requirements

When sharing images created with Selfie Anywhere, you MUST:

• Clearly disclose that the image is AI-generated when asked
• Comply with platform-specific AI content disclosure requirements
• Not misrepresent the image as a real photograph

4.2 Platform Compliance

Many social media platforms require disclosure of AI-generated content. You are responsible for:

• Understanding and complying with each platform’s policies
• Using appropriate labels or tags (e.g., #AIGenerated, #AIArt)
• Responding honestly when others ask about image authenticity

5. Intellectual Property

5.1 Your Content

You retain rights to your original Base Image. By uploading a Base Image, you:

• Confirm you have the right to use that image
• Grant us a license to process it for Service functionality
• Acknowledge it will be processed by third-party AI services

5.2 Generated Content

Images generated by the Service:

• May be used by you subject to these Terms
• Cannot be claimed as your original photography
• May not be eligible for copyright protection (varies by jurisdiction)

5.3 Service Content

All Service elements (software, design, branding) remain our exclusive property. All rights, title, and interest in and to the App, models, filters, algorithms, data, and documentation remain with Selfie Anywhere; no ownership or intellectual property rights are transferred to you.

5.4 License to Your Content

You grant us and our service providers a worldwide, non-exclusive, royalty-free license to host, process, reproduce, display, and otherwise use your Base Images and related content solely to operate, maintain, improve, and provide the Service to you, including safety and abuse prevention. This license ends when you delete the content, subject to reasonable backup retention described in Section 6.3.

5.5 Feedback

If you provide suggestions or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use it without restriction or attribution.

5.6 Survival After Deletion

Deleted content may persist temporarily in backups for up to 90 days and may be retained longer as required by law or to resolve active abuse or legal matters. We do not use deleted content to train models.

6. Privacy and Data

6.1 Data Collection

We collect and process:

• Account information (email, authentication data)
• Base Images you upload
• Generated images and associated metadata
• Usage data and analytics

6.2 Data Processing

Your Base Images and generated content are processed by:

• Our servers (Cloudflare infrastructure)
• Google’s AI services (Gemini)
• Third-party mapping and location services
• We do not use your Base Images or generated images to train or fine-tune models; processing is solely to provide the Service

6.3 Data Retention

• Active account data: Retained while your account is active
• Generated images: Retained until you delete them
• Deleted content: Moved to secure archive for 90 days, then permanently deleted
• Analytics data: Retained in anonymized form

7. Subscription and Payments

7.1 Free Tier

• Limited number of generations per period
• Variable free credits may be granted and adjusted at our discretion
• Images may include promotional watermark
• Subject to availability and fair use

7.2 Paid Subscriptions

• Billed through Apple App Store
• Subject to Apple’s payment terms and refund policies
• Auto-renews unless cancelled at least 24 hours before the renewal date
• Renewal charges may process within 24 hours prior to period end
• Manage or cancel in Settings > [your name] > Subscriptions; deleting the app does not cancel
• Intro offers or free trials convert to paid unless cancelled before the trial ends
• Price changes follow Apple’s notice process; continued use after notice accepts the change
• No refunds for partial periods beyond Apple’s policies; your statutory cancellation or refund rights (if any) remain unaffected and are handled through Apple
• Restore subscriptions from your Apple ID using App Store restore flows

7.3 Consumable Purchases (Credit Packs)

• One-time in-app purchases sold and fulfilled via Apple
• Credits are delivered immediately to the purchasing Apple ID and are non-transferable
• All sales are final except where required by applicable law or Apple policy
• Credits expire only as stated in-app; we may grant bonus credits at our discretion

8. Custom Licensed Application Terms (Apple App Store)

8.1 Custom EULA + App Store Terms

• This document is the Custom EULA for Selfie Anywhere distributed via the Apple App Store and governs your license from us.
• You must also comply with Apple’s App Store terms (including Apple’s Standard EULA only as between you and Apple). Those terms do not change this license from us.
• Your license is granted by Selfie Anywhere (Application Provider). All rights not expressly granted are reserved.

8.2 Scope of License

• Nontransferable license to use the app on Apple-branded devices you own or control, per App Store Usage Rules.
• You may install and use the app on personal devices under your control and are responsible for meeting minimum system requirements.
• Do not distribute the app over a network for simultaneous use; remove the app before selling or transferring your device.
• No transfer, redistribution, sublicensing, copying (beyond Usage Rules), reverse engineering, disassembly, source-code derivation, modification, or derivative works except where legally permitted or allowed by open-source component terms.

8.3 Consent to Use of Data

• Licensor may collect technical data about your device, system, application software, and peripherals to provide updates, support, and services.
• Data may be used in non-personally identifying form to improve products, services, or technologies.

8.4 Termination

• This license remains effective until terminated by you or by us and ends automatically if you breach it.

8.5 External Services

• Access to third-party or Licensor services/websites is at your sole risk; Licensor is not responsible for their content or accuracy.
• Data displayed (including financial, medical, or location data) is informational only and not guaranteed.
• Do not use External Services to infringe rights or to harass, abuse, stalk, threaten, or defame.
• External Services availability may vary by language or location; compliance with applicable laws is your responsibility.
• Licensor may change, suspend, remove, disable, or restrict External Services at any time without notice or liability.

8.6 Warranty Disclaimer

• THE LICENSED APPLICATION AND ANY SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS. ALL STATUTORY, EXPRESS, AND IMPLIED WARRANTIES ARE DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLUDING MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW CERTAIN DISCLAIMERS.

8.7 Limitation of Liability

• TO THE EXTENT NOT PROHIBITED BY LAW, LICENSOR IS NOT LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION) ARISING FROM USE OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY.
• LICENSOR’S TOTAL LIABILITY IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE APP IN THE SIX (6) MONTHS BEFORE THE CLAIM AROSE, EXCEPT AS REQUIRED BY LAW FOR PERSONAL INJURY. SOME JURISDICTIONS MAY LIMIT THESE EXCLUSIONS.

8.8 Export and Sanctions Compliance

• You must comply with applicable export, import, and sanctions laws (including those of Brazil, the U.S., and the EU) and confirm you are not on any government-restricted or prohibited party lists.

8.9 Governing Law and Jurisdiction (App Store License)

• This license follows Brazilian law (without conflict-of-law rules) and uses Section 13 for dispute resolution and venue. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

8.10 Third-Party Beneficiary; Support

• Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it.
• Apple has no obligation to furnish maintenance or support beyond what we are required to provide under applicable law or our policies.

9. Disclaimers and Limitations

9.1 Service Provided “As Is”

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

• Fitness for a particular purpose
• Accuracy or quality of generated images
• Uninterrupted or error-free operation
• Compatibility with your expectations

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amounts you paid us for the Service in the six (6) months preceding the claim
• We are not responsible for how you use generated content
• We are not liable for third-party actions based on your content

9.3 AI Limitations

You acknowledge that AI-generated content:

• May contain errors, artifacts, or unrealistic elements
• May not accurately represent locations or environments
• May produce unexpected or undesired results
• Is not suitable for use as factual documentation

10. Indemnification

You agree to indemnify and hold harmless Selfie Anywhere, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your misuse of generated content
• Your violation of any third party’s rights
• Any fraudulent or illegal use of the Service

11. Notice of Alleged Infringement or Likeness Violation

To request removal of content you believe infringes copyright, trademark, or likeness rights, email support@selfie-anywhere.app with:

• Your name, contact information, and electronic signature
• A description of the work or right allegedly infringed
• Identification of the material you believe is infringing and where it appears (account, screenshot, URL, or in-app location)
• A statement of good-faith belief that the use is unauthorized
• A statement, under penalty of perjury, that the information is accurate and that you are the rightsholder or authorized to act

We may remove or disable access to the disputed material and may notify the account holder. If you are in the U.S., counter-notices under the DMCA may be sent to the same address and must include your signature, identification of the removed material and its prior location, a statement under penalty of perjury that the removal was mistaken, and consent to jurisdiction and service of process. We may restore content at our discretion where legally permitted. Outside the U.S., provide equivalent statements required by local law.

12. Account Termination

12.1 By You

You may delete your account at any time through the app settings. Upon deletion:

• Your subscription will be cancelled
• Your data will be scheduled for deletion
• No refunds for remaining subscription time

12.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• We suspect fraudulent or illegal activity
• Required by law or legal process
• The Service is discontinued

You may request review or appeal of a suspension or termination by emailing support@selfie-anywhere.app; we may refuse or limit appeals for repeated or severe violations.

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Brazil, without regard to conflict of law principles.

13.2 Arbitration and Class Waiver

Any disputes shall be resolved through binding arbitration, except where prohibited by law. Where permitted, you waive the right to participate in class or representative actions. You may opt out of arbitration and the class waiver within 30 days of accepting these Terms by emailing support@selfie-anywhere.app with your account email and a clear opt-out request. Opting out does not affect the governing law.

13.3 Exceptions

Arbitration does not apply to:

• Intellectual property disputes
• Emergency injunctive relief
• Small claims court matters

13.4 Non-Applicability in Certain Jurisdictions

If mandatory local law (for example, in the EU or UK) does not allow arbitration or class waivers for you, then the competent courts for your residence will have jurisdiction and the class waiver will not apply.

14. Miscellaneous

14.1 Entire Agreement

These Terms constitute the entire agreement between you and Selfie Anywhere.

14.2 Severability

If any provision is found unenforceable, the remaining provisions continue in effect.

14.3 No Waiver

Failure to enforce any right does not waive that right.

14.4 Assignment

We may assign these Terms. You may not assign without our consent.

14.5 Security Reports

To report a security vulnerability or abuse, contact support@selfie-anywhere.app with enough detail for us to investigate.

4. You have read and agree to these Terms of Service.

Selfie Anywhere is committed to responsible AI use. We actively monitor for misuse and cooperate with authorities when required by law.
